Resorts Casino Hotel in Atlantic City is facing an age-discrimination lawsuit after firing sixteen middle-aged waitresses for being “unfit’ to wear the casino’s sexy new uniforms.

The women, between the ages of 40 and 60, were all long-time employees of the casino and relieved to keep their jobs after the resort was sold to Casino Executive Dennis Gomes. However, their relief didn’t last long. The casino soon introduced sexy flapper style uniforms (right) and each waitress was required to try on the new gear and pose for a photograph (allegedly taken from the waist down).
Waitress Terry Bruno described the process as humiliating:
"You're too stiff. You're too that. Turn. You're holding the number wrong. Spread your legs. Don't do this. Don't do that. And then, that was it. And then based on those pictures, two weeks later we all received a similar phone call telling us we didn't fit the uniform requirements."
Union officials claim the casino used the flapper uniforms to get rid of older waitresses in an attempt to attract younger clients. According to onlinepoker.net, the resort hired 40 new waitresses, nearly all in their 20’s (like those above), after firing the 16 long-time employees.
Resorts responded to the allegations in a written statement:
“All cocktail servers were given individual consideration and the selection process was conducted in a fair and objective manner. We empathize with the cocktail servers who lost their jobs and gave them hiring preference in other open positions at Resorts.”
The fired waitresses say they just want their job back and are even willing to wear the new uniforms.
Do you think the casino behaved badly here or that they were well within their rights?
